Macomb Township Consumer Fireworks Ordinance:

ARCTICLE IV. - CONSUMER FIREWORKS

Sec. 11-44. - Definitions.

The following words, terms and phrases, when used in this article, should have the meaning ascribed to them in this section except where the context clearly indicates a different meaning:

"Consumer fireworks" means firework devices that are designed to produce visible effects by combustion, that are required to comply with the construction, chemical composition and labeling regulations promulgated by the United States Consumer Product Safety Commission under 16 CFR parts 1500 and 1507 and that are listed in APA standards 87-1, 3.1.2, 3.1.3, or 3.5. Consumer fireworks does not include low-impact fireworks.

"Low-impact fireworks" means ground and handheld sparking devices as that phrase is defined under APA standard 87-1, 3.1, 3.1.1.12, 3.1.1.1.8, and 3.5.

"Person" means an individual, agent, association, charitable organization, company, limited liability company, corporation, labor organization, legal representative, partnership, unincorporated organization, or any other legal or commercial entity.

Sec. 11-45. - Regulations; days/hours.

No person may ignite, discharge or use consumer fireworks, except on the following days after 11:00 a.m.:

December 31 until 1:00 a.m. on January 1.

The Saturday and Sunday immediately preceding Memorial Day until 11:45 p.m. on each of those days.

June 29 to July 4 until 11:45 p.m. on each of those days.

The Saturday and Sunday immediately preceding Labor Day until 11:45 p.m. on each of those days.

Sec. 11-46. - Penalties.

An individual violating this article shall be responsible for a civil fine of one thousand dollars ($1,000.00) for each violation of this article. Remittance of five hundred dollars ($500.00) of the fine collected under this article shall be remitted to the local law enforcement agency responsible for enforcing this chapter.
